 Frequently Asked Questions (FAQs) About Starting a PERM Based Green Card Case with Xie Law Offices, LLC.

Q1:  My employer wants to sponsor my PERM labor certification based green card application.  Can you do it for me, as we not in the same state?
A: Sure!  We can handle your case as long as it is US immigration related.  As a matter of fact, we have had excellent experience with the PERM based green card process, and we have obtained 100% success rate on the PERM applications.

Q2: How much will the whole process cost?
A: There are two types of fees involved: Attorney's service fee and other fees charged by a third party such as the newspaper publisher and USCIS.  For more information about the fees, click here.

We can only control the attorney's fee, and therefore we can tell you how much the attorney's fee is. Please call us or send us an email for the quote.  You also need to email us a copy of your updated resume for evaluation.  

Q3: I have a foreign born spouse who needs to get a green card with me.  Will there be any additional attorney's fee for my spouse?
A: Yes.  Additional attorney's fee will be charged as the attorney's fee before we start to prepare the I-485 application for the spouse.  If the spouse needs to apply for immigrant visa at a US Consulate overseas, contact us about the fee information.

Q4: What documents do you want from me?

A: You should also send me the following documents with the signed agreement and the check: 

1. A copy of your passport (the photo page, visa stamp page, and I-94 card).  
2. A copy of your degree certificates and the transcripts (photocopies and unofficial transcripts are fine).
3. A copy of your updated/detailed resume.
4. Completed forms (will be emailed to you after you retain our services).
5. A copy of your job offer letter if available.


Q5: How can I start your services?

A: Thank you for your interest in our service! To start your case with this office, you should email a copy of your updated resume to us at help@xielaw.com and request a copy of the Attorney-Client Agreement.   We will email you the agreement, and you need to mail the signed agreement and the initial attorney's fee to us at the address below. Please note: effective from July 16, 2007, this initial attorney's fee must be paid by the sponsoring employer if the employer does not handle or does not have another attorney handling the labor certification.


Q6: How much will the advertisements cost?
A: It will depend on the size of the ad and the rate the publisher charges.  We will not know the cost until we actually send the ad to the publishers and ask for the quote. This advertisement fee must be paid by the sponsoring employer.

Q7. How much will the USCIS filing fees cost?
A: USCIS changes the filing fees almost every one or two years. After July 30, 2007) the fees are as follows:

1. I-140 filing fee =$475 (for the principal applicant only )
2. I-485 filing fee =$1010 ($600 if under 14 and filing with the I-485 application of at least one parent or $930 if under 14 and NOT filing with the I-485 application with at least one parent.)


The fees listed at 1and 2 are required, which means that these fees must be paid before we can get your green card applications approved. The fees are required ONLY when you want to get the work permit or travel documents.

Above fees are charged by and paid to the US Department of Homeland Security. These fees are subject to change by the government without notice. These fees are needed only when requested by this office.

Q8: How will you help me to complete the application (application steps)?
A: We will email you the step-by-step instructions as soon as we become your attorney.

Q9: How long will it take to complete the PERM application?
A:  The employer is required to conduct the recruitment activities during the first two months.  If everything goes smoothly, we will file your application in the third month.  How long will it take for USDOL to approve the application?  It is hard to tell or predict.  We have cases approved within 24 hours, we have a few cases approved after five months of filing.  And it seems to us that it is getting longer and longer for USDOL to approve the applications.  It has been said that the USDOL has new "backlogs" under the new PERM system!

Q10: What will your office guarantee us? What can your office not guarantee?
A: We can guarantee the quality of our work on your case.  We can guarantee we will prepare and file your application without unnecessary delay by/in our office.  However we cannot guarantee WHEN (the timeframe) your application will be approved.  Why so? Once your application is filed, it is out of our control.
