Summary of ISD Teleconference of July 11, 2002

1. Is premium processing available for blanket "L" petitions?

 Yes.

2. We understand that INS runs certain checks on corporate petitioners.  Please clarify the nature of such checks.

 Checks are not run as a matter of course on corporate entities.  However, they will be done on individual petitioners.  Examiners have the discretion to check a corporate entity on IBIS.

3. Please advise our members of the current status of the impact of the IBIS checks at the Service Centers.

 Service Centers are unlikely to return to pre-IBIS processing times in the near future.  There have been system enhancements that will help to improve processing times and should enable Service Centers that are now at 120 days on I-129 petitions to get closer to 90 days by the end of the year.  It will be difficult to improve processing time beyond 90 days without additional staffing.  INS did commission a Time and Motion Study which is now complete and INS is awaiting the report, which should be useful to identify resource requirements.

4. We understand that the implementation of I-140 premium processing has been delayed.  Can you give our members an idea of when we might expect implementation or reconsideration of an implementation date?
 
The date has not yet been determined.  It is first necessary to evaluate the impact of IBIS and the possible impact of I-140/I-485 concurrent filings.
