Change of employer: No new visa is necessary if ...

Q: Revalidations are not available if there is more than 60 days of validity to a visa. However, where an alien has changed employers, it is desirable to have the visa conform to the petition approval. Is it possible to have a visa revalidated (or reissued at a post) where there is a change of employers, even though there is more than 60 days of visa validity left?

A: There is no requirement for an alien to obtain a new visa when he/she has changed employers, as long as the I-797 is valid and reflects the new employer. The Department has limited acceptance of revalidations to applicants whose visas have 60 or fewer days of validity as a way to keep visa processing down to the minimum time possible for more urgent cases, and has no plans to revise this policy. If applicants who have changed employers prefer to have new visas before their current visas have expired, they can apply overseas. Applicants should check with the appropriate consular section for specific procedures in effect.
