Any United States citizens can file if
- He or she plans to adopt a foreign orphan.
- He or she is at least 24 years of age as long as he or she will be at least 25 when an
orphan petition is filed in behalf of an actual child and when the child is adopted.
Permanent residents can file as long as they obtain their citizenship at the time of
actual adoption.
