What is in the national interest?
A new decision by the INS' Administrative Appeals Unit (AAU) provides seven flexible
factors to help determine what is the "national interest" for purposes of the
new employment-based second preference (EB 2) immigrant visa category.
The AAU set forth the following seven factors to consider in applying the national
interest test:
- improving the U.S. economy;
- improving wages and working conditions of U.S. workers;
- improving education and training programs for U.S. children and underqualified workers;
- improving health care;
- providing more affordable housing for young and/or older, poorer U.S. residents;
- improving the U.S. environment and making more productive use of natural resources; or
- involving a request from an interested U.S. government agency.
