Minutes of AILA – MSC meeting July 19, 2002

  1. EAD Production. The problem with EADs not being produced in some cases has been due to a problem with matching the image (photo) with the card. There were about 8,000 cards involved. MSC believes they have the problem resolved for future I-765s and have worked through the 8,000 or so cards that had not been produced.

  2. Processing times. for I-601, I-824, and I-102 are current (i.e., within 30 days of receipt) because the volume is extremely small.

  3. IBIS checks. IBIS checks have resulted in a slow down of about 25%. The worst is over but processing times are not likely to ever return to pre-IBIS productivity.

  4. G-28 image/data issues. There has been a disturbing pattern of attorneys not receiving notices from MSC. On investigation, it appears there are two distinct problems. One is related to image…the other to improperly completed G-28s. The image problem may be solved two ways. Either be certain that the G-28 you use is “1st generation” (in other words, is a crisp, sharp original and not a faded or blurred 3rd, 4th, or 20th generation copy). The second solution is to provide a white G-28 on top of the blue G-28. Why? The MSC prototype system collects data by scanning the documents at the Chicago “lock-box.” If the image is blurred on the G-28 (black ink on blue background), the image may provide insufficient data.
    The second G-28 relates to improperly completed or incomplete G-28s. G-28s will be rejected if:
  • Missing signature-applicant
  • Missing signature-attorney
  • Incomplete address
  • Foreign address
  • Invalid revision date (using 09-26-00 version is “safest” because MSC acquires data through scanning rather than keying)
  1. REMINDER Adjustment of Status. The only adjustment applications (I-485s) processed at MSC are LIFE Legalization. DO NOT FILE I-485s for Ks & Vs at MSC. I-485s for Ks and Vs are filed at the local district office.

  2. V Visa Issues. (1) There has apparently been some confusion with the V approval notices. Despite the plain language in the 3rd and 4th paragraphs, apparently some individuals believe they can use the V approval notice (I-797A) as a visa or travel/entry document. One possible solution would be to simply reordering the paragraphs making the current 3rd & 4th became the 2nd & 3rd and moving the current 2nd to 4th position. Until there is a change (if there is a change) p lease spread the word that the V visa approval notice from MSC works like any other approval notice…ONLY with a valid visa.

  3. V Visa Issues. (2) Reminder that MSC can only grant V-2 status until the 21st birthday.

  4. Expedite issues. Discussed expedites at MSC and reiterated that the MSC expedite policy will follow the guidance provided in the Fujie Ohata memo of November 30, 2001.

  5. Facilities Tour. Tentatively scheduled for Sept 23rd (Monday starting at 10:30 AM).

  6. Chicago Lock Box. The Chicago Lock Box address should be used for initial filings only. All other correspondence and evidence should be mailed to the Service Center directly:
