This is a visa available to Canadian citizens and Mexican citizens under the North American Free Trade Agreement ("NAFTA") which was implemented on January 1, 1994.

Must be Canadian citizen or Mexican citizen.
Must be in a profession defined by the NAFTA.
Must possess the required credentials to be considered a professional.

A TN professional may make an initial application for TN status at a Class A port of entry or pre-flight inspection station. The current INS regulations suggest that an alien already in the United States under some other status may not seek a change of status to TN; they must instead seek TN status at a port of entry or pre-flight inspection station. According to 8 CFR §214.6(i)(2), a Canadian citizen already admitted in TN status may file a petition with the INS to change to another TN employer or add an additional TN employer.

The maximum initial period of stay that may be granted for a TN professional is one year. A TN professional may request extensions of stay for one-year increments with no fixed limit on the number of extensions that may be given. Extensions of stay for TN status must be filed with the Nebraska Service Center. However, the TN professional may also renew his or her status by re-applying at a Class A port of entry.

Because the short period of TN visa and the need to apply for renewal, TN professionals who are concerned about immigrant intent problems should consider changing their status from TN to H-1B

TN visa/status holder's family members get TD visa/status.
