H-1B visa is one of nonimmigrant visas. An H-1B visa can be issued to foreign individuals who want to work in the United States as professionals. Any one who has a four year college degree or work experience equivalent to a four year college degree may be eligible for a H-1B visa. In more detail, an H-1B visa applicant must satisfy the following requirements: 1. He/she is a professional (college degree holder or many years' work experience). 2. He/she has been hired by a U.S. employer. 3. The U.S. employer hired him or her to do the job he or she was trained to do. 4. The U.S. employer is willing to file a petition on his or her behalf. 5. There are still quota available (there is a maximum of 115,000 H-1B visas issued each year, 195,000 for the year of 2001, 2002,and 2003). The process of applying for an H-1B visa is relatively complicate and time consuming. It has to deal with both the Department of Labor and the Immigration and Naturalization Service and must obtain approval from both agencies.
