Steps and Documents for Preparing Your H-1B:


1. Request a copy of Attorney-Client Agreement and document list by sending an email to us at help@xielaw.com
2. Send the required documents to our office by mail, fax or email.
3. Attorneys will review the documents for completeness and contact you and the employer if we have any questions.
4. We will prepare the necessary paperwork and send it to the employer for review and signature 
5. We will submit the H-1B petition package with USCIS after we receive the signed paperwork and the filing fee checks from the employer.
6. We will get the
H-1B approved and notify you and the employer of the approval notice immediately!**

Sample List of Documents needed from the employee (beneficiary):

  1. A copy of recent resume.
  2. If you have never had an H-1B before : copy of I-94 card, both sides; copy of I-20 (student) documents, both sides; employment authorization card, two sides.
  3. If have an H-1B before: copy of all H-1B approval notices and other current status documents
  4. Copy of your college degree certificates and transcripts (Bachelor’s Master’s, Ph.D. etc), with certified English translation if not in English; If your Bachelor degree is a foreign degree and you do not have any other degree(s), you need to have your Bachelor degree evaluated by INS authorized organization with fee;
  5. Copy of your passport, and your family members’ passport(s) if they need to change status with you;
  6. Your social security number & salary.
  7. If in H-1B status now, provide a copy of the current employment evidence such as pay checks or employment verification letter.

Sample List of Documents needed from/about the employer:

  1. New employer’s full legal name, address, telephone number and fax number
  2. New employer’s Federal Employer Identification Number (federal tax ID number)
  3. The name and title of the employer’s representative who is authorized to sign the petitioning documents
  4. The name of the contact person whom we may contact for additional assistance (optional)
  5. Employer’s annual gross income or sales and the net income (if available)
  6. The year the company founded and the number of current employees
  7. A copy of the employer’s brochure or promotional materials or web address
  8. A copy of detailed job description or offer letter from the new employer (optional)

Fees: 

Attorney fee (paid to your attorney for his service to you): Contact us, payable to Xie Law Office 

Filing fees (paid to "Department of Homeland Security) (subject to change without notice): 

(1) $320, H-1B form filing fee (additional $300 filing fee for family members if H-4 is filed).

(2)$1500 if the employer is employing 25 or more full time employees and is a non-academic or research organization. OR $750 if the employer is employing fewer than 25 full time employees and is non academic or research organization.

(3)$1000 ONLY if you want USCIS to process your H-1B within 15 days of the filing!!!

(4) $500 "Fraud Prevention and Detection Fee", which must be paid by the employers seeking a beneficiary’s initial grant of H-1B or L nonimmigrant classification or those employers seeking to change a beneficiary’s employer within H-1B or L classifications. 

In addition, you may need to pay Educational evaluation fee if no US degree.
