Online Status Check on Labor Certification Applications Pending at DOL Backlog Elimination Centers (BEC)

The DOL has updated its website to include an on-line BEC case status system, a new FAQ on the case status system, and a new FAQ for cases for which there has been no contact from a BEC. A link to the updated site is available on AILA InfoNet at document #06091277: http://workforcesecurity.doleta.gov/foreign/times.asp The site contains a link to the Backlog Public Disclosure System (PDS) which employers, attorneys, agents, and aliens can use to determine the status of an application filed at a BEC. The new FAQ on the case status system outlines the process and remedy available to employers who believe a case has been closed due to issues surrounding the receipt of or response to a "45-day" Center Receipt Notification Letter (45-day letter), such as cases in which the employer or attorney received a case closed letter but did not previously receive a 45-day letter or those that were closed after the employer or the employer's representative responded timely to a 45-day letter. To be considered for case reopening, all requests must be received by the appropriate BEC within 30-days of the publication of this policy announcement (by October 11, 2006) or within 30-days of the receipt of a case closed letter, whichever is later. Regarding cases pending at the BEC for which no contact (e.g., no 45-Day letter, case closed letter, or other correspondence about the case) from the BECs has been received, the new FAQ outlines specific steps for employers or their attorneys to follow.
